Terms of Service

By accessing or using CADDIXA, you agree to these Terms of Service. If you do not agree, do not use the service. You must be at least 16 (EU/EEA/UK) or 13 (US) years old and able to form a binding contract.

CADDIXA provides tools for golf club calculation, simulation, and club data management. The service is operated by Rin Sawasaki, Toyama ("we", "us").

You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.

You agree not to:

• Use the service unlawfully or in violation of these Terms;
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the service;
• Upload malicious code or scrape data without permission;
• Infringe the rights of others or submit data you have no right to share.

You retain ownership of the club, component, and measurement data you submit ("Your Content"). You grant us a worldwide, non-exclusive license to host, process, and use Your Content to operate and improve the service. Where you submit measured or component data intended for shared databases, you grant us a license to use it for those features. You are responsible for ensuring you have the right to submit Your Content.

CADDIXA is currently free to use. We may introduce paid plans in the future. If we do, pricing, billing, renewal, and refund/cancellation terms will be presented before you purchase and will form part of these Terms. EU/UK consumers may have a statutory right to withdraw from certain digital purchases, subject to applicable exceptions.

The CADDIXA application, including its software, design, and content (excluding Your Content), is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the service for its intended purpose.

CADDIXA provides calculation results for informational purposes only. We do not guarantee the accuracy, completeness, or reliability of any result, and CADDIXA does not provide professional fitting or engineering advice. Club building and modification can affect safety and performance; you are responsible for verifying all specifications and consulting a qualified professional before building or using a club.

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100. Nothing in these Terms limits liability that cannot be limited by law.

You agree to indemnify and hold us harmless from claims, damages, and expenses arising out of your use of the service, Your Content, or your violation of these Terms or applicable law.

You may stop using the service at any time. We may suspend or terminate your access if you violate these Terms or to protect the service or other users. Upon termination, sections that by their nature should survive (e.g., disclaimers, liability limits) will remain in effect.

CADDIXA relies on third-party providers (e.g., hosting, database/authentication, and email). We are not responsible for the availability or actions of third-party services. See our Privacy Policy for details on data processing.

These Terms are governed by the laws of Japan, without regard to conflict-of-laws rules. Disputes will be subject to the exclusive jurisdiction of the Tokyo District Court, Japan as the court of first instance. If you are a consumer in the EU/EEA or UK, you retain the mandatory protections and the right to bring claims under the law of your country of residence.

We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, provide additional notice where required. Continued use after changes take effect constitutes acceptance.
